Privacy, terms and intellectual property

1. Who we are

IV Talent ("we", "us") runs Culture Lens Circles, an invitation-only service that helps a leadership team reflect on how it works together, including a voice check-in guide. IV Talent is located at 1000 2nd Ave S, HQ 300, North Myrtle Beach, South Carolina 29582, USA. For check-in data collected on behalf of a client organisation, that organisation and IV Talent agree who is the controller in their written agreement; IV Talent decides how the service itself is run and secured. 2. What we collect

Account data: name, email address, role (team member, leader or IV Talent), a rater code, and sign-in records.
Check-in answers: your daily scores, written comments and the date of each check-in.
Voice conversations: if you choose to talk to your check-in guide, speech is processed in real time to produce responses and to record answers you agree to save. No recording of your voice is kept by the check-in.
Consent records: when you agreed to take part and whether you switched on voice.
Technical and security data: activity and audit logs, IP address, browser and timestamps.

Please do not share health, medical, religious, political or other sensitive personal information, or details about identifiable people beyond what a comment needs. The service is not directed to anyone under 16.

3. Confidentiality of your answers

Personal data is processed by IV Talent under UK GDPR and EU GDPR. Individual answers are never shared with your leader or company. Your data is deleted only on a formal data request or when you leave your organisation; contact support@iv-talent.com.

Your individual answers and comments are seen only by you and by IV Talent, who run the programme. The leader and the wider company never see your individual answers. Any summary shared beyond IV Talent combines at least five people and has names and identifying details removed. These rules are enforced in the database itself, not just on screen.

Your private journal is visible only to you. IV Talent cannot read it in the app; it sees only unnamed themes drawn from it. IV Talent staff with access are bound by confidentiality obligations, and every administrative action is logged.

4. Why we use it, and legal bases

To run the check-in, show you how your own views change over time, prepare combined team summaries, keep the service secure and meet legal obligations. Where UK GDPR or EU GDPR applies, our bases are: your consent (which you give before your first check-in and may withdraw at any time), legitimate interests (security and service improvement that do not override your rights), performance of a contract with your organisation, and legal obligation. We do not sell personal data, use it for advertising, or make automated decisions with legal or similarly significant effects.

5. Service providers and international transfers

We use carefully selected providers, including cloud hosting and database, voice technology (ElevenLabs), smart-technology providers reached through a secure gateway (used, for example, to summarise the themes in your own comments for you), and email delivery. They process data only on our instructions. Check-in data is stored in the European Union where our providers allow. Where personal data is transferred outside the UK or EEA, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses, the UK Addendum, or a provider's certification under the EU-US Data Privacy Framework. A list of current providers is available on request.

6. Data retention

Check-in answers, comments and consent records: kept for the programme and deleted 12 months after it ends, unless your organisation's agreement sets a different period.
Daily check-ins and private journal entries: kept on the same basis as check-in answers.
Your answers, ratings, daily check-ins and journal entries cannot be deleted from inside the app. They form a consistent record for the programme. They are deleted only (a) when you make a formal data request under section 7, or (b) when you leave your organisation and it or you ask us to remove them. Deletion is carried out by IV Talent and recorded in our activity log.
If you withdraw consent, you stop taking part straight away; your data is then handled as a formal deletion request.
Activity and audit logs: 24 months.
Summaries of the themes in your comments are created when you look at them and are not stored.

Copies held by our providers (for example conversation records at our voice provider, email logs and backups) follow those providers' own retention and may persist for a short period after deletion.

7. Your rights

Depending on where you live (including the UK, EEA, Switzerland and US states such as California, Virginia and Colorado), you may have the right to access, correct, delete, port or restrict use of your personal data, to object to processing, to withdraw consent, and not to be discriminated against for exercising these rights. Send requests to support@iv-talent.com; this is also the contact point for people in the UK and EEA and for supervisory authorities. We will verify your identity and respond within the period required by law (generally one month). Requests to delete check-in data are handled this way, not through the app. Some information may be kept where the law requires it or for the defence of legal claims, and we will tell you if so. You may also complain to your local data protection authority, such as the UK Information Commissioner's Office.

8. Security

We use encryption in transit, invitation-only access, role-based permissions enforced in the database, and activity logging. No system is perfectly secure; if a breach affecting your personal data occurs, we will notify you and regulators as the law requires.

9. Cookies

We use only essential storage needed for sign-in, security and remembering simple preferences (such as where you placed your check-in guide). We do not use advertising or analytics cookies. If this changes we will update this notice and ask for consent where required.

10. Terms of use

Access is by invitation only and is personal to you; do not share your password. You must not attempt unauthorised access, reverse engineer, scrape, overload or misuse the service, or submit unlawful content.

Your check-in guide. The guide uses smart technology and may be inaccurate or incomplete. It is not professional, medical, psychological or legal advice. If you are in distress, please contact a qualified professional or your local emergency services.

Disclaimer and liability. The service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. To the extent permitted by law, IV Talent is not liable for indirect, incidental or consequential damages, or loss of data, profits or goodwill. Nothing here limits liability that cannot be limited by law.

Governing law. These terms are governed by the laws of the State of South Carolina, USA, subject to any mandatory consumer or data-protection rights in your country of residence. Any separate written agreement with your organisation prevails over these terms.

11. Confidentiality and intellectual property

All material in the check-in is confidential and may not be copied, shared or disclosed without written permission. The software, questions, scoring, guide, methods, designs and text are owned by or licensed to IV Talent and protected by copyright, trademark, trade secret and other laws.

IV Talent, IV Field Advisors, CultureLens and associated names and logos are trademarks or trade names of IV Talent or its affiliates, whether or not registered. You keep ownership of what you write; you grant IV Talent a limited licence to process it solely to run the check-in for you and your organisation. We do not use your content to train third-party models.
